Do I need a Probate Attorney?

Although it is not required in the State of Colorado, it is highly recommended that you seek both legal and tax counsel regarding probate and estate related issues. Often times, attorneys who specialize in wills, trusts, estate and probate law provide a free consultation where you can discuss your specific situation.

What do Probate Attorneys Cost?

Each attorney and law firm may have different fee structures, however, the most common are:

• Flat Fee

• Hourly

• % of the Total Value of the Estate

Some attorneys charge an up front retainer fee and some bill on a monthly basis and some will wait until real estate properties or other assets are sold, generating funds to cover legal fees.

Personal Representative Liability

As the personal representative you may be liable to the beneficiaries for any loss to the estate and for any gain the estate should have realized, but did not. You should contact a probate attorney and seek their advice as to any potential problems that may arise.
